These Terms of Service govern your use of rizo.store and purchases from Rizo Apparel LLC (“Rizo,” “we,” “us,” or “our”). By using this website or placing an order, you agree to these Terms.
PRODUCTS AND AVAILABILITY
Rizo designs and sells apparel, accessories, and related goods. Many products are produced in small batches, limited quantities, preorder runs, or made-to-order formats.
Availability may change without notice. We may limit quantities, discontinue products, refuse orders, or cancel orders where reasonably necessary, including suspected fraud, payment issues, inventory errors, pricing errors, abuse of promotions, unauthorized resale activity, or violations of these Terms.
If we cancel a paid order before fulfillment, we will refund the amount paid for the cancelled portion.
We make reasonable efforts to display product colors, materials, images, and measurements accurately. Screens, lighting, garment blanks, printing, finishing, and hand-produced details may create reasonable variations. Minor variations are not necessarily defects.
ORDERS, PRICING, AND PAYMENT
Submitting an order is an offer to purchase. An order confirmation confirms that we received your order but does not guarantee acceptance or fulfillment.
We may correct pricing, inventory, typographical, or listing errors before fulfillment. If a correction materially affects your order, we may contact you for approval or cancel and refund the affected item.
You represent that you are authorized to use the payment method submitted with your order.
SHIPPING
Our Shipping Policy forms part of these Terms.
Product-specific, preorder, custom, or made-to-order shipment estimates control when stated.
Delivery dates are estimates unless Rizo expressly states otherwise.
If we cannot ship within a promised timeframe, or within the timeframe required by applicable law when no timeframe was stated, we will provide any delay notice, cancellation option, consent request, or refund required by law.
Customers are responsible for providing a complete and accurate shipping address. Address changes are not guaranteed after an order enters processing.
Additional shipping costs caused by an incorrect address, refused delivery, or unclaimed package may be charged where permitted by law and where the issue was not caused by Rizo.
RETURNS AND REFUNDS
Returns, exchanges, and refunds are governed by the Return and Refund Policy posted on rizo.store and any product-specific terms shown before purchase.
Nothing in these Terms removes rights that applicable law does not allow us to waive.
LIMITED RELEASES, PREORDERS, AND MADE-TO-ORDER PRODUCTS
Limited releases may sell out quickly and may never be restocked.
Preorder, custom, and made-to-order products may require longer processing and production periods than in-stock merchandise.
Production timing may be affected by garment availability, suppliers, printing, production, finishing, quality control, demand, or other circumstances.
Estimated production or shipment windows are not guaranteed delivery dates.
If a delay gives you a cancellation or refund right under applicable law, Rizo will honor that right.
SITE USE
You may use rizo.store only for lawful purposes.
You may not interfere with site security, introduce malicious code, attempt unauthorized access, impersonate another person, submit fraudulent payment information, abuse discounts or promotions, scrape the site in a manner that disrupts our systems, or use the site to violate the rights of Rizo or another party.
INTELLECTUAL PROPERTY
The Rizo name, Rizo marks, artwork, graphics, photographs, product designs, site design, copy, and other original content are owned by or licensed to Rizo Apparel LLC unless otherwise stated.
Purchasing a product does not transfer ownership of Rizo intellectual property.
You may not reproduce, distribute, sell, modify, or commercially exploit protected Rizo content without written permission except where permitted by law.
USER CONTENT
If you voluntarily submit reviews, photographs, comments, designs, tags, or other content to Rizo, you represent that you have the right to share it.
When you expressly submit content to Rizo for reposting, promotion, or publication, you grant Rizo a non-exclusive, worldwide, royalty-free license to reproduce, resize, crop, display, and use that submitted content for Rizo marketing and storefront purposes.
You retain ownership of your original content.
THIRD-PARTY SERVICES
Rizo may use services provided by Shopify, payment processors, shipping carriers, analytics providers, social platforms, and other third parties.
Those services may have separate terms and privacy practices. Rizo is not responsible for services or websites we do not control except where responsibility cannot legally be excluded.
DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, RIZO.STORE AND ITS ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
EXCEPT FOR EXPRESS PROMISES MADE BY RIZO AND WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED, RIZO DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
This does not remove any warranty or consumer right that applicable law does not allow us to waive.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, RIZO APPAREL LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SITE, AN ORDER, OR A PRODUCT.
Where liability may legally be limited, Rizo’s total liability relating to a specific purchase will not exceed the amount paid to Rizo for the product or order giving rise to the claim.
These limitations do not apply where applicable law does not allow liability to be limited or excluded.
INDEMNIFICATION
To the extent permitted by law, you agree to defend and indemnify Rizo Apparel LLC from third-party claims, losses, or reasonable expenses resulting from your unlawful misuse of the site, infringement of another person’s rights, fraudulent activity, or content submitted by you in violation of these Terms.
This does not apply to claims caused by Rizo’s own unlawful conduct.
CHANGES
We may update products, prices, site features, policies, and these Terms from time to time.
Changes apply prospectively from the date posted unless applicable law requires otherwise.
Discontinuing a product or website feature does not eliminate obligations already owed on accepted orders.
GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law.
To the extent legally enforceable, disputes relating to these Terms or purchases from Rizo will be brought in a state or federal court having jurisdiction in Allegheny County, Pennsylvania.
This does not remove any non-waivable right a consumer may have under applicable law.
GENERAL TERMS
If any provision of these Terms is found unenforceable, the remaining provisions remain effective.
Our failure to enforce a provision is not a waiver of that provision.
These Terms, together with the policies and product-specific terms presented on the store or at checkout, form the agreement between you and Rizo regarding your use of the store and purchases.
